Customer Notification & Disclaimer of Liability

IMPORTANT: Do not use Equilibrium Tuning Inc. ("EQT") products until you have read this disclaimer. Installation of any EQT product indicates your total acceptance of these terms. If you do not agree, you may return the product in new, unused condition within 14 days of purchase for a refund.

1. Competition Use Only (Emissions & Legality)

  • Race-Only: EQT products are designed solely for legally sanctioned, closed-course, off-road competition. They are not legal for sale or use on pollution-controlled vehicles driven on public roads.

  • Compliance: EQT does not bypass, delete, or disable any emissions-related codes or monitors. Maintaining a compliant vehicle is the sole responsibility of the end user.

  • Disclosure: By purchasing, you certify that your use is limited to lawful off-road competition and consent to the disclosure of your identity to regulatory entities if required.

2. Limited Warranty & Mandatory Inspection

In the event of a defect in materials or workmanship, the Seller’s sole and exclusive obligation is limited to the repair, replacement, or refund of the purchase price, at the Seller’s discretion and in accordance with Seller's return and refund policies. 

  • Inspection Requirement: No warranty claim is valid unless the Product is returned to the Seller for inspection. The Seller has the sole right to determine if a defect exists.

  • Voidance: Any warranty claim is void if the Product is repaired, disassembled, or disposed of prior to the Seller’s inspection.

  • Burden of Proof: The purchaser bears the full burden of proving that the Product contained a defect and that such defect directly caused the claimed damage.

3. Absolute Waiver of Liability

Equilibrium Tuning, Inc. (“Seller”) shall not be held liable for, and the Buyer assumes all risk for:

  • Secondary Costs: Labor, towing, storage, loss of use, or loss of profits.

  • Vehicle Damage: Damage resulting from improper tuning, detonation, overheating, lubrication failure, fuel system limitations, or any other condition beyond the Seller’s control.

  • Warranty & Safety: Voidance of factory vehicle warranties, property damage, personal injury, or death.

4. Installation & Technical Responsibility

Installation is the sole responsibility of the Buyer or their chosen installer. The Seller is not responsible for:

  • Improper installation, incorrect torque procedures, or contamination.

  • Failure to follow installation instructions or provide appropriate engine calibration/supporting modifications.

  • Failure to properly monitor engine vitals and operating conditions.

5. Governing Law & Dispute Resolution

Any dispute arising from the purchase or use of this Product shall be governed by the laws of the State of California and resolved exclusively in the state or federal courts located within California.

Terms and Conditions Acknowledgement

Order Verification: Due to a recent increase in fradulant purchases at EQT, we ask that when finalizing your order that you please check the box "Use shipping address as billing address". If you do not do this or ship your order to a non-matching billing address, you will be asked to provide additional verification. This is for our customers safety and we appreciate your understanding.

Order Processing: Processing times are seperate from shipping times. Your order will be processed within 3-5 business days (during sales, processing times may take up to 10 business days), then shipped via your selected shipping method.

EQT Sales: During sales, some items may temporarily be on backorder, but rest assured we will work to get your order out as soon as possible. If your order has not been shipped within 10 business days feel free to email support@eqtuning.com with your order number for an updated ETA.
